Dale, I'm making this an Open Letter to you because you have refused
to respond to my private attempts to contact you. I sent this to you
originally on March 17th. I also emailed you on March 19 and again on
March 25th -- still no response.

Now that you have finally established that there were more than
enough ballots in the box impounded on Nov. 19 to make quorum in both
the Listeners' and in the Staff elections at WBAI, I am writing to
you to ask you to take the following measures pertaining to the
election. Should you do so, the lawsuit over the elections will be
ended, you would save the station tens of thousands of dollars in
unnecessary legal fees and a black-eye from losing in court. Let's do
what the bylaws say, put all of this behind us, and get back to the
business of doing radio and improving upon it -- and saving the
station and network. I ask you to:
Declare that as Elections Supervisor, you
1) Hereby reverse Casey Peters' decisions to extend the elections
beyond the date carved in stone in the bylaws -- November 15, 2007.
2) Deem as legitimate for the purposes of this election ONLY:
a) those ballots in the box impounded on Nov. 19, 2007 AND
b) those ballots received by you at the station on November 16, 2007 AND
c) the votes of those who requested Replacement Ballots on or
before (and ONLY on or before) November 15, 2007.
3) Rule as null and void those ballots submitted by individuals who,
for whatever reason, were not members as of the Record Date of August 31.
I believe that this is what the Judge will rule in Court. You have
now the power to make this decision, and we could all forego the
expenses (financial, and in terms of time and energy) of continuing
the lawsuit, which is only asking the Judge to rule that the bylaws
prevail in these matters.
You'd be doing a real service to Pacifica and reversing some of the
more ridiculous, costly, and unnecessary errors that had been made by
the former (and now fired) Elections Supervisor.
